The Consequences of Unauthorized Construction: A Cautionary Tale



In a recent ruling, the Ernakulam District Consumer Disputes Redressal Commission imposed a fine of ₹2.85 lakh on Galaxy Homes, a construction company, for attempting to sell an unauthorized flat. The company had constructed a building beyond the permitted limit and sold it to a consumer under false pretences, which ultimately led to significant legal consequences.


The Case Overview

In 2017, a resident of Vyttila, Joco Antony, booked a two-bedroom flat on the ninth floor of a project by Galaxy Homes. He paid ₹25,000 as a booking fee, followed by ₹7 lakh by the booking terms. However, when Antony approached the bank for a loan to pay the remaining amount, he was shocked to learn that the building only had approval for seven floors. Due to this discrepancy, the bank rejected his loan application.

The Consumer's Plight

Despite repeated requests, Antony only received ₹5 lakh of the total amount he had paid. Left with no other option, he approached the Consumer Disputes Redressal Commission to seek justice. The Commission, comprising President D.B. Binu and members V. Ramachandran and T.N. Srividya, heard the case and ruled in Antony's favour.

The Commission's Ruling

The Commission not only ordered Galaxy Homes to refund the remaining amount with a 9% interest calculated from the booking date but also imposed a fine of ₹2.85 lakh. The company was given 30 days to comply with the order. The ruling emphasized that owning a home is a fundamental dream for any individual, and attempts to shatter this dream through unethical practices would not be tolerated.

Lessons for Homebuyers and Builders

This case serves as a crucial reminder for both homebuyers and construction companies. For buyers, it highlights the importance of verifying all approvals and legalities before making any financial commitments. For builders, it underscores the need for transparency and adherence to regulations, as the consequences of failing to do so can be both financially and reputationally damaging.
